The legal particulars set out below constitute the General Conditions for the use of the site: these conditions, which are subject to French law, govern the use of all the site’s functionalities and apply to any person gaining access to the site (hereafter called “user” in the text). The simple fact of browsing on the site pre-supposes firm and unreserved acceptance of all the contents of this document.

Legislation applicable to the site

The site is governed by French law.  

Access to the site

Access to the site is free of charge. However, the fees for access to, and use of, the telecommunications network must be borne by the user.  

The user acknowledges that he has the competence and resources necessary to gain access to, and to use, the site; he acknowledges, in particular, that he has checked that the computer equipment he is using in order to connect with the site contains no virus and that it is in perfect operating order.    

The site is available 24 hours a day, 7 days a week, except in the event of force majeure, of computer difficulties, of problems relating to the structure or operation of the communication networks, or of any other technical difficulty. Moreover, for maintenance reasons, GAREAT may interrupt access to the site, in which case it will do its utmost to warn users in advance.  

 

Computers and Liberties

In accordance with Law N° 78-17 of 6th January 1978 relating to computers, files and liberties (the so-called “Computers and Liberties Law”), all data of a personal nature concerning users which may be gathered and processed will be so in compliance with the provisions of the said law (under the responsibility of GAREAT in its capacity as the party responsible for processing).

The purpose of processing users’ personal data is the following:  

  • Processing and monitoring of requests made by users via the site’s heading “Contact us” (requests for information, requests for membership, technical questions…).

Exercise of the right of access

In application of Law N° 78-17 of 6th January 1978 relating to computers, files and liberties, the user has the right, for any legitimate reason, to object to (Art.38 of the law), to gain access to (Art. 39 to 43 of the law), and to rectify (Art. 40 of the law) the data concerning him. Thus, the user may require the rectification, completion, clarification, updating or deletion of data which concerns him and which is inaccurate, incomplete, ambiguous or out of date, or whose gathering, use, communication or conservation is forbidden.

The computerised registers, which are conserved in GAREAT’s systems in full compliance with the rules of the art in security matters, qualify as evidence between GAREAT and the users.
